पर्यावरण के लिए ज़रूरी कानूनी कार्यवाही की कमियों को कैसे कम करें ?
पर्यावरणीय न्याय के लिए समुदाय आधारित शोध के तरीकों पर कार्यशाला
दुनिया भर में आज के विकास के मोडल के पर्यावरणीय, सामाजिक और आर्थिक प्रभावों का बोझ हाशिए पर रहने वाले समुदायों को असमान रूप से झेलना पद रहा है और इस ‘विकास’ की कीमत यही समुदाय अदा क्र रहे हैं। चाहे प्रदूषण करने वाली औद्योगिक इकाइयां हों या नदियों को रोकने वाले बाँध. चाहे नगरपालिका के कचरे की डंपिंग साईट हो या खनन परियोजनाओं. यह न केवल ज़मीन के उपयोग को बदल देती हैं बल्कि समुदायों को उनकी आजीविका और संसाधनों से बेदखल कर जहरीले प्रदूषण को भुगतने के के लिए छोड़ देती है. इनमें से कई परियोजनाओं को उन कानूनों द्वारा नियंत्रित किया जाता है जो प्रभावित समुदायों की पहुँच से बहुत दूर बनाये जाते हैं। उनके उद्देश्य या कार्यान्वयन की सीमा केवल नीति निर्माताओं, कंपनियों और कुछ विशेषज्ञों तक ही सीमित रह जाती है जो इस विकास के नकारात्मक प्रभावों के भुक्तभोगियों से कोसों दूर हैं ! यह सिर्फ कागजों में रहती हैं और वर्षों से हानिकारक परियोजनाएं इन कानूनों का घोर उलंघन करती आ रही हैं। साथ ही यह भी हमें समझना होगा की नव उदारवादी व्यवस्था में निजी कम्पनियां और सरकारें मिल कर बचे खुचे पर्यावरण कानूनों में भी ढिलाई छह रही हैं ताकि मुनाफे में इजाफा किसी भी कीमत पर होता रहे.
पर्यावरणीय न्याय सुनिश्चित करने के लिए की जाने वाली कार्यवाही एक ऐसा विषय है जिस पर बहुत कम शोध करा गया है तथा जिसे सबसे कम समझा गया है। चूंकि पर्यावरणीय न्याय के लिए की जाने वाली कार्यवाहियों मे वैज्ञानिक और तकनीकी पक्ष भी शामिल होते हैं, इसलिए अक्सर इन कार्यवाहियों को तय करने की ज़िम्मेदारी,तकनीकी विशेषज्ञों, नियामक एजेंसियों तथा उद्योगों के सदस्यों के ऊपर डाल दी जाती है । इसकी योजना बनाने या इसे ज़मीन पर लागू करने मे जनता की भागीदारी या समुदाय की कार्यवाही दिखाई नहीं देती है ।
पर्यावरणीय न्याय सुनिश्चित करने के लिए बनाई जाने वाली योजना, बनाने और करी जाने वाली कार्यवाही, मे जनता की भागीदारी, विकास के दुष्प्रभावों को कम करसकते हैं । यह जनता को कार्यवाहियों की देखभाल करने वाला तीसरा वैधानिक पक्ष बना सकता है । वरना यह सिर्फ सरकार और कंपनियों द्वारा ही किया जाता है । इससे निर्णय लेने की प्रक्रियाओं मे सुधार आयेगा और उद्योग की स्थापना उनके विस्तार और उस क्षेत्र मे नए निवेश के बेहतर अवसर निर्माण मे सहूलियत होगी ।
कौन आवेदन कर सकते हैं ? : युवा शोधार्थी , कार्यकर्ता , समुदाय आधारित संगठन , जो औद्योगिक एवं ढांचागत निर्माण के क्षेत्र मे पर्यावरणीय न्याय की कार्यवाहियों मे रुची रखते हों । ऐसे इच्छुक आवेदक ढाई दिन की कार्यशाला मे भाग ले सकते हैं, जो पर्यावरणीय न्याय मे समुदाय की भागीदारी के लिए शोध के तरीकों , सिद्धांतों और कार्यवाहियों पर चर्चा सत्रों मे भाग ले सकेंगे ।
कार्यशाला की लागत हेतु आपका अंशदान : 3 दिन के लिए कार्यशाला के आयोजन मे प्रति सदस्य करीब रुपए 2500/- का खर्चा आएगा । जिन प्रतिभागियों को आंशिक छूट चाहिए वे अपने आवेदन मे कृप्या इसका ज़िक्र करें ।

Closing the Environmental Compliance Gap
A workshop for Environmental Justice activists
Across the world, marginalized communities bear a disproportionate burden of the environmental, social and economic cost of development. Projects such as polluting industrial units, municipal disposal sites or mining projects not only trigger land use change but also expose communities to toxic contamination, adversely affecting their livelihoods and imposing restrictions on their access to common resources and mobility. Many of these projects are meant to be regulated by laws that are crafted far away from the affected communities. Their stated purpose or extent of implementation is known only to policy makers, the projects and few experts. They remain in the books while harmful projects continue operations for years in gross violation or non-compliance of these laws. The neoliberal development paradigm to sustain necessarily requires dilution of environmental laws in order to ensure economic growth and that is the process we see happening in the country today as well.
In the field of environmental justice through regulation, compliance is one of the least understood and researched topics. Since compliance may involve scientific and technological aspects of the environment, it is mostly left to technical experts, regulatory bodies and members of the industry. Owing to the lack of public knowledge, compliance has rarely seen public engagement or community action at the field and at policy levels.
Citizen engagement in the policy and practice of environmental compliance can reduce the environmental and social impacts of development, can make them the legitimate third party in monitoring systems that is otherwise comprised of only the government and companies, and can lead to an inclusive decision making on new projects, expansions and sectoral investment. We see this as an additional tool in the hands of the communities to assert their rights over their lives and resources as well as challenge the impunity with which projects violate environmental laws.
Who Can Apply: Applications are invited from young researchers, activists and community organisations interested in working on environmental compliance of industrial and infrastructure projects. Selected applicants can attend a 2.5 days workshop on community-based research methods on environmental compliance and classroom sessions on concepts and practice of compliance.
